Reducing Federal Estate Taxes
The new tax laws affect both the taxes on your estate but also the amount passed on to your heirs. Starting in 2010, the basis of an asset acquired from a beneficiary will be "carried over". This translates into the beneficiary paying tax on the asset based on your cost basis when the asset is sold. Subject to certain limitations, you can increase the basis up to $1.3 million -- sparing the beneficiary from inheriting a costly tax liability. For assets transferred to spouses the basis may be increased by up to $4.3 million. The higher the cost basis, the lower your tax liability.
