Probate is a legal process by which the probate court:

Determines whether your will is valid;
Ensures all of your oustanding financial obligations
are met through distribution of your assets; and
Sees to it that assets in excess of your debts are distributed according to your will.

Probate's function is to title your assets in the name of the beneficiary. While the process of changing title to assets is usually necessary, probate is not always necessary. Even with a will, beneficiaries cannot simply take title without going through the probate process and receiving the assets by a court order. The exceptions to a court ordered change of title are:

Jointly-owned property automatically transfers
to a surviving spouse; and
Assets with proper beneficiary designations
(usually an insurance policy).
